I was treated right after the accident for whiplash. It’s in my medical records but then was unable to go to treatment for some time because of other problems but injury got worse now the chiropractor won’t work on me because he says the insurance company won’t usually pay after this time loss. Also the auto insurance company won’t preauthorize treatment and I can’t afford the a visit co-pay required for using my health insurance. I’m on Social Security.

I doubt you can since you refused treatment at the time of the injury.

It could easily be argued that your present situation is your choice, caused by you refusing to receive treatment when it was initially made, not the accident itself.

I was riding in the backseat of my friends auto-mobile when he rear-ended another car at about fifty miles per hour. Thankfully no one was seriously hurt but both myself and another friend in the car had serious neck and back pains, because something could have been broken they took us to the hospital in an ambulance and did around three x-rays.

About five hours later we were given some drugs for the road and taken home.

Kemper, my friends insurance, called me to ask how I was doing and to get my account of the accident. I tried my best to act nicely to them even though they continued to forget what I had said only two seconds prior, and seemed to be nit-picking everything I had said. I figured it was just part of their job. The next couple days I started to feel the after effects of the accident. I had hit my head against the seat hard enough to pass out and knock a tooth loose, because of how I had been sitting my chest also crashed against it, because I am such a small person the pressure made it hard to breathe for the past month.

I work as a daycare provider and running around with the kids all day only made me realize how bad my back really was. I had insurance with Kaiser but they’re only station of Chiro’s is about an hour away, I consulted Kemper and they promised to pay up to 10,000 dollars in my recovery for the next three years. Satisfied I went to an old friend nearby who was fair in his pricing. The next three months I had to go to the dentist, doctor, and pharmacy many times, but I paid for them all because my back was my main concern.

I didn’t ask for any money from Kemper except to pay for my back treatment.

Sure enough this was too much to ask.

The x-rays and treatment for the hospital ended up pricing about 10,200 dollars, and Kemper claims since they paid 500 for the ambulance and 1,500 for the doctors fee AT the hospital, they only have to pay 8000 of the hospital bill, and none of my chiro bills.

The woman who had called my from Kemper didn’t say anything about my hospital bill being included in the recovery funds, and the fact that they cut me off at such a low number only leads me to thank god that I didn’t actually break anything or I’d be paying for it my whole life since these cheapskates don’t actually care.

They know that my family doesn’t have much money and we’re living from pay check to pay check, so 3,000 dollars is a lot of debt, however I know that a lawyer would cost just as much if not more!

I guess what I’d like to know is if I do have a case, or if the insurance assholes have won because my limit is up and there’s nothing I can do about it. Any help from people who know would be great and my family and I would really appreciate it…

Most personal injury attorneys will listen to your case at no charge (a consultation). If they think they can recover any money for you, they will usually represent you at no charge, and only take a fee if they win. But be careful, there are fees, and there are expenses. Some attorneys will only take a fee if they win, but bill you for expenses whether you win or lose. You want an attorney that won’t charge you anything if they lose, and only take their fee if they win (no expenses, which can eat up the remaining portion of your settlement if you win).

NEVER talk to an insurance company from another party until you’ve talked with your insurance company first. They will twist anything you say into their favor. They will take a statement like “I’m OK”, and take that to mean you didn’t suffer ANY injury at all.
